Terms and Conditions

 

These Terms and Conditions constitute an agreement between your team and Coexist Gaming that governs your team’s participation in the DEV EXP Game Jam. Please read the Terms and Conditions carefully.  By participating in the DEV EXP Game Jam, you affirm that your team has read, understood, and accepted these terms and conditions.  If your team does not agree with any of these terms and conditions, please do not participate in the DEV EXP Game Jam.

The DEV EXP Game Jam is open to children 13 or older and adults of all ages. When you participate in the DEV EXP Game Jam, you agree to abide by these Terms and Conditions and the rules and eligibility requirements, located here: https://www.coexistgaming.com/devexp.

The DEV EXP Game Jam encourages the creation of games that celebrate collaboration and can be shared freely for download and play. However, we also understand the need for individuals and companies to protect their intellectual property rights. Generally, this means you cannot use copyrighted works in your game without receiving explicit permission from the copyright holder(s) or giving proper attribution if required by the license.

You are responsible for making sure you have the necessary rights, licenses, or permission for any game you submit as part of the Game Jam. By submitting your game to the DEV EXP Game Jam, you affirm, represent, and warrant that you own or have the rights, licenses, permissions, and consents necessary to publish, duplicate, and distributed the submitted game.

Coexist Gaming, do not condone activities that infringe or appear to infringe the intellectual property of others. Such activities may result in disqualification from the DEV EXP Game Jam are notified of such violations and removal of your game from the competition. Removal and disqualification may occur without prior notice.

Teams share ownership rights to the games they submit to the DEV EXP Game Jam with Coexist Gaming. By submitting a game to the DEV EXP Game Jam, you hereby grant Coexist Gaming, a license under the Creative Commons Attribution-ShareAlike 4.0 license. If you do not want to license your game under this license, then do not submit it to the DEV EXP Game Jam.

You represent and warrant that you shall not transmit, post or upload any game that is, in whole or in part, libelous, scandalous, inflammatory, discriminatory, defamatory, false, threatening, vulgar, obscene, pornographic, profane, abusive, harassing, invasive of another’s privacy, hateful or bashing, aimed at gender, race, color, sexual orientation, national origin, religious views or disability, or otherwise unlawful, or that violates or infringes on the privacy, publicity, intellectual property, proprietary, or contractual rights of any person or entity. If you include pictures of others in your game, you represent and warrant that you have those persons’ (or if the person is under the age of majority, the person’s parent or guardian’s) consent.

You agree to defend, indemnify, and hold harmless Coexist Gaming®, and all their directors, officers, employees, agents, faculty members, students, and affiliates (all of which are “Game Jam Entities”), and to defend and hold each of them harmless, from any and all claims and liabilities (including attorneys’ fees) arising out of or related to your breach of the Terms and Conditions or your participation in the DEV EXP Game Jam.

The Game Jam Entities shall not be liable to you or any third parties for any direct, indirect, special, consequential or punitive damages of any kind, regardless of the type of claim or the nature of the cause of action, even if the Game Jam Entities have been advised of the possibility of such damages. Without limiting the foregoing, the Game Jam Entities shall have no liability to you or any third parties for damages or harms arising out of your game.

No waiver of any term of these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term, and the failure by Coexist Gaming® to assert any right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision.

These Terms and Conditions, together with other documents referenced herein, constitute the entire Terms and Conditions governing you and your team’s participation in the DEV EXP Game Jam and supersede all previous agreements.
